READ THE FOLLOWING SECTIONS FULLY AND CAREFULLY PRIOR TO SIGNING. THIS IS A LEGALLY VALID AND BINDING OBLIGATION TO RELEASE PWC OWNER FROM ALL KNOWN AND UNKNOWN OBLIGATIONS, AND TO INDEMNIFY BOAT OWNER AGAINST CLAIMS BROUGHT AGAINST IT BASED UPON YOUR USE OF THE CRAFT. THIS INSTRUMENT AFFECTS IMPORTANT LEGAL RIGHTS.

 

Release and Waiver of Claims.

For valuable consideration, the receipt and sufficiency of which are hereby acknowledged Renter does hereby remise, release, and forever discharge PWC Owner, PWC Owner’s agents, servants, successors, heirs, executors, administrators and personal representatives, of and from all, and all manner of, actions, causes of action, suits, proceedings, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or equity, which Renter ever had, now has, or which Renter’s heirs, executors, administrators or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause, or thing whatsoever arising out of this Agreement; out of the use (misuse, or abuse) of the Craft; or in any way arising out of the rental relationship between Renter and PWC Owner.

 

Indemnification

For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Renter hereby expressly agrees to indemnify and hold harmless PWC Owner, PWC Owner’s agents, servants, successors, heirs, executors, administrators and personal representatives against all suits, actions, claims, demands, or damages that arise out of Renter’s use, misuse or abuse of the Craft.

Terms and Conditions


  1.  Assumption of Risk.  Renter acknowledges that the activities for which the Craft is designed include inherent dangers, including the risk of bodily injury and/or death.  Renter assumes and accepts all risks associated with the use of the Craft.

  1. Acceptable Use.  Renter agrees and acknowledges that he/she will be the sole responsible person of the Craft, and will use the Craft in a careful, safe and conscientious manner.  Renter shall at all times observe and adhere to any rules and guidelines posted by PWC Owner, and any applicable laws or regulations.  

 

  1.  Prohibited Activities.  Renter shall not violate any of the following rules and regulations during his/her operation of the Craft:

 

  • There are no additional passengers permitted on the Craft unless expressly permitted by PWC Owner in writing prior to use (must sign liability waiver and rental agreement)
  • Smoking is allowed, but must be done responsibly. Ash trays must be used and any damage to the boat will be billed to the renter.
  • Alcoholic beverages are allowed for passengers, but are strictly prohibited for the driver. Police are actively monitoring the waters and DUI or arrest may occur if any drinking and driving is occurring. All towing fees which may result would be the liability to the renter in this case. The owner or driver (if applicable) has sole discretion to drop off any overly intoxicated passengers or guests who are acting inappropriately at the pick-up point and will not refunded and if necessary law enforcement may be called.
  • There are no pets permitted on the Craft.

 

  1.  Age.  Renter is old enough to operate the Craft, according to the state’s minimum operating requirements.  (applies to driver only)
  2. Unsafe Use.  If at any time PWC Owner determines that Renter has engaged in an unsafe or hazardous use of the Craft, PWC Owner may immediately terminate the rental.  Upon notification of termination, Renter must return the Craft to the designated docking area immediately.  If the rental is terminated for unsafe or hazardous use, Renter will not be refunded his/her security deposit.  PWC Owner shall determine, in its sole discretion, whether any behavior or activity is “unsafe or hazardous.”

 

  1.  Condition of Craft upon Return.  The Renter shall return the Craft to the designated docking area clean, free of garbage and debris, and in the same condition as it was in when given to Renter, excepting ordinary wear and tear.  Renter shall be responsible for any damage caused to the Craft during the rental period.  PWC Owner shall retain any portion (or all) of Renter’s security deposit as necessary to cover repairs for such damages.  To the extent that damages to the Craft exceed the amount of the security deposit, Renter shall be billed by PWC Owner for the full amount of damages caused by Renter during the rental period, including reasonable attorney’s fees.

 

  1.  Late Return.  If Renter returns the Craft to the designated docking area more than 20 minutes after the scheduled “Time In,” Renter shall forfeit his/her security deposit.  


Boat Rules:

  1. In the event of a mechanical problem, inclement weather, or unforeseen driver circumstances, Social Floats may at any time up until the booking cancel and refund the amount. We will do our very best to avoid cancellations or rescheduling, but reserve the right should circumstances require it. In this case we will work with you to make alternative arrangements or reschedule your event for another date and time that works for you.
  2. Cancellations: 1 month+ is your entire money back, A 2-4 weeks rain check provided, 0-2 weeks is no refund. If bad weather or unsafe conditions are present, the captain will cancel tours and rain checks provided.
  3. You are a NO SHOW after 60 minutes. CALL IMMEDIATELY if you are running late 612-424-3569 or you lose your deposit. 
  4. If you book multiple boats and then cancel one or more of them THE SAME POLICY APPLIES. We will not offset the deposit against the boat you are still taking.
  5. Late Fees – if you are late returning the boat, you will be charged $100 per hour that you are late. 
  6. Boats are confirmed by size within the same category and not by specific boat. We reserve the right to switch boats on you due to scheduling or maintenance issues. If a boat in the same category is not available we will upgrade you to the next category at no additional charge.
  7. No drinking and driving. It’s the LAW! If you get a BUI (Boating Under the Influence) it goes on your permanent driving record. No kidding! MN State is 0.08 when driving a boat, just like a car.
  8. You must be 21 to rent an engine powered vessel or 18 to rent canoes and kayaks.
  9. Boats may only be driven by the designated driver/s on the contract. The boat driver must be born before January 1, 1988
  10. Boats WILL be cruised at 3/4 throttle, not full throttle. Not only is this better for the engine, but outboard engines at full throttle are going to use a lot more gas, for very little extra speed.
  11. BALANCE the passengers on the boat so it does not list to one side or ride bow down in the water. To many people in the bow converts the pontoon into a submarine, and that is never good!
  12. No towing of any boat for any reason.
  13. No skiing, tubing or towing of persons in the water.
  14. No diving or jumping off boats while in motion, as tempting as it may seem at the time. 
  15. No bow riding – all passengers MUST remain inside the railings while the boat is in motion, it’s the law.
  16. No fires or grilling on boats – you may bring a grill to cook out on the island.
  17. No mooring at other docks, unless prior permission is obtained and noted on your contract.
  18. Children 12 and under must wear a life jacket at all times while on the boat – it’s the LAW! We provide USCG approved life jackets for children and infants of all sizes.
  19. Stay between channel markers at all times while in a marked channel. Remember: RED, RIGHT, RETURN.
  20. Obey No Wake Zones at all times. The designated No Wake Zone is between channels (marked by red and green at channels) or where marked as (slow)
  21. You are responsible for your boat, motor, equipment and passengers. You break it, you bought it! See our list of charges for any items lost or broken. And nope, we do not offer insurance.
  22. When trimming up the engine, do NOT allow the propeller to come out of the water when the engine is on. You loose steering and damage the engine. We’ll have a field day with your credit card!
  23. When a larger boat approaches you in the channel give them the right of way.
  24. DO NOT beach the boat.
  25. When dropping an anchor, yank on it first to make sure it is set – the grass flats in our area can sometimes jam up an anchor so it just skids and does not set properly the first time.
    Rinse the mud off anchors before stowing them on board. 
  26. If you get lost, call for instructions. We will talk you through using the GPS to find your way home.
  27. If your boat does not start, call us. We can probably figure it out on the phone. If not, we’ll come and get you. If we find it was “operator error” due to you not following the instructions, you will be charged $100 per hour for our time and gas.
  28. If you add a captain to your rental your are STILL responsible for any damages caused to the boat by your party. You are only absolved from any damages caused in the operation of the boat (such as damaged propeller, etc.) If you tear the upholstery or loose the ladder, expect a bill from us.

 

Passenger Release of Liability Waiver and Behavior Agreement

 

I understand that participating on the Social Floats Boating Tour is a potentially dangerous activity. I assume the risk that I may be injured and/or injure someone else while using the SocialFloats boat tour . I assume all risks associated with my use of the SocialFloats boat tour, as well as all risk of loss, theft or damage of personal property while using or present on the SocialFloats boat tour or at the establishments/locations where the tour may visit or at any other time and any other location before, during and after the tour. I will not bring any action against SocialFloats (Hire Service Pros LLC), its employees, successors and/or assigns, for personal injury, property loss, or property damage, including any action for negligence, breach of warranty, products liability or strict liability, and hereby forever waive, on my own behalf and on behalf of my successors and/or assigns, the right to bring such action.

 

I affirm that I am at least eighteen years of age and of sound and sober mind and capable of making this Release. Further, I agree that I understand all the language in this document and what I am doing and agreeing not to do by signing it. If I did not fully understand what this document means, I would not sign this document or use a SocialFloats boat tour until I had been advised regarding it by my own attorney.

 

The SocialFloats boat tour is of proprietary manufacture, and I agree not to reverse engineer, build or cause to be built any vehicle of the same or similar construction. I further agree to release, indemnify and hold harmless the owners and manufacturers of the SocialFloats boat tour from any liability against any and all claims, including damages or demands of third parties, including but not limited to, successors and assigns, as a result of my use of the SocialFloats boat tour.

  1. All riders must be 12 years of age or older, or wear life preservers and be under the strict supervision of a guardian for the entire time. All riders aboard tours that serve alcohol must be 21 years of age or older.
  2. Renters may bring beer or wine or other fermented beverages on board as allowed by law. No hard liquor.
  3. All alcoholic beverages and people holding them must remain on the SocialFloats boat tour at all times.
  4. Any person arriving in an intoxicated condition shall not be allowed to board the SocialFloats boat tour.
  5. The SocialFloats Captain is responsible for the SocialFloats boat tour and his/her decisions are final.
  6. All laws and rules regarding alcohol and behavior apply to all passengers before, during and after SocialFloats boat tour tours. Inappropriate behavior will result in the offending passenger(s) being asked to disembark immediately. No refund will be issued to passengers(s) asked to disembark. Passengers will be responsible for their own transportation from point of disembarking. Inappropriate behavior includes but is not limited to: • Extreme intoxication • Giving alcohol to non-passengers • Foul Language or Gestures • Public urination /vomiting • Loitering more than 5 minutes after tour • Excessive noise/screaming
  7. Any and all open alcoholic beverages will be collected and discarded five minutes before the tour ends. No exceptions.
  8. Any transgressions of the above restrictions may result in the captain ending the tour immediately and causing a minimum $300 Late/Damage/Violation Fee to be charged to the Renter’s credit card. No refund will be issued for tours ended early due to passenger behavior.
  9. All laws and rules regarding alcohol apply to all passengers before, during and after SocialFloats boat tour tours.
  10. A $100 “Abandonment” fee will be charged to “Mixer” tour riders not returning to the starting point. *Write the following statement on the line below. “I decline the offer to wear a free use of a life preserver, although they are readily available under seats. “
